This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. Solicitation H92241-04-R-0055 is issued as a Request for Proposal. The incorporated provisions and clauses are those in effect through FAC 2001-24. The items to be quoted are 53 each Stormscope Systems WX 500 Part Number 830-11500-001, which consists of the following: Processor Unit P/N 805-11500-001; Processor Mount P/N 805-11590-001; NY 163 Antenna (Black) P/N 805-10930-002; Gasket Storm Scope Ant P/N 78-8060-5977-6; Hardware Package P/N 817-11501-001; and End Panel P/N 800-11592-001. Items are to be delivered the Government warehouse in Lexington KY. All items must be delivered no later than 120 days after contract award. FOB point is origin. Inspection and acceptance shall be at origin by the Government. This RFP does not provide for full and open competition. Justification for Other than Full and Open Competition is FAR 6.302-1, 10 U.S.C. 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The intended source is L-3 Communications Avionics Systems, Grand Rapids, MI. Only L-3 Communications has the technical capability and access to proprietary data required to provide these items. The NAICS code is 334511 and the small business size standard is 750 employees. DPAS assigned rating is DO-A1. This RFQ incorporates the following provisions and clauses: FAR 52.212-1, Instructions to Offerors - Commercial; FAR 52.212-2, Evaluation – Commercial Items; FAR 52.212-3, Offeror Representations and Certifications – Commercial Items; FAR 52.212-4, Contract Terms and Conditions; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders; DFARS 252-212-7000 Offeror Representation and Certifications – Commercial Items; and DFARS 252-212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisition of Commercial Items. Any award resulting from this RFP will be issued on a SF 1449 and will incorporate all clauses required by law, the FAR and the DFARS as appropriate.
