The Sierra Pacific Network Consolidated Contracting Activity (CCA) is issuing a Commercial Item Request for Proposal (RFP) in accordance with FAR 12.203 to purchase Fresenius HyperCare Application Software. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a proposal is being requested and a written solicitation will not be issued. This procurement is a sole-source justified action as Fresenius HemoCare, Inc. is the only firm available to provide middleware capable of uploading dialysis data into the existing VA systems VistA and CPRS. The simplified acquisition procedures of FAR Part 13 will be used in conjunction with commercial items procedures of FAR Part 12. The NAICS code is 339112, with a small business size standard of 500 employees, and the Product Service Code is 6515. The solicitation number for this RFP is VA-261-06-RP-0077. The following provisions and clauses apply to this solicitation: FAR 52.212-1 Instructions to Offerors - Commercial Items (Jan 2006) and addendum; FAR 52.212-3Offeror Representations and Certifications - Commercial Items (MAR 2005), Offerors must include a completed copy of the provision with its offer; FAR 52.212-4 Contract Terms and Conditions - Commercial Items (SEP 2005); FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (FEB 2006), For the purposes of this clause items 14, 15, 16, 17, 18, 19, 20, 26 and 32 are considered checked and apply; FAR 52.232.18 Availability of Funds (APR 1984); FAR 52.247-34 F.O.B. Destination (NOV 1991); VAAR 852.270-1 Representatives of Contracting Officers (APR 1984); and VAAR 852.270-4 Commercial Advertising (NOV 1984). Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-10. This is a best-value procurement.
