This amendment is to clarify that the 50% requirement that is mentioned in the Sources Sought Notice is based on the clause at FAR 52.219-14, which will be included in the resultant contract IF any portion of the resultant contract is a Small Business Set Aside. This clause is required by FAR 19.508(e). The clause states that the contractor is required to "perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials." So the 50% is evaluated mathematically by examining manufacturing costs excluding materials. However, it should be noted that this does not apply to a non-manufacturer of such supplies. In this case, refer to FAR 19.502-2(c) which states, in part, "any concern proposing to furnish a product that it did not itself manufacture must furnish the product of a small business manufacturer unless the SBA has granted either a waiver or exception to the nonmanufacturer rule." A listing of waivers is available on the SBA's website at www.sba.gov/content/class-waivers. According to the current list, a waiver has not been issued for rocket motors.
