The Naval Air Systems Command intends to award sole source, cost-type contract actions to Raytheon Missile Systems, Tucson, AZ, for design and development of AIM-9X missile upgrades. These contract actions for the AIM-9X missile system will include design changes needed to address existing obsolescence issues, design and development to address Insensitive Munitions requirements, and design and development needed to extend the effective range. The authority for Other Than Full and Open Competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "only one responsible source and no other supplies or services will satisfy agency requirements." In 1996, Raytheon Missile Systems (formerly Hughes Missile Systems Company) was competitively selected as the designer, developer, manufacturer and integrator of the AIM-9X missile system. The Government did not procure a Technical Data Package for re-procurement purposes and required Raytheon to retain configuration control of all items not affecting the system specification. Access to the Technical Data Package is required in order to perform the design and development for these requirements. Award to a source other than Raytheon would result in substantial duplication of costs that are not expected to be recovered through competition and unacceptable delays in fulfilling agency requirements.
