INTRODUCTION

THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION.

The National Institutes of Health, National Institute of Child Health and Development (NICHD), intends to award a purchase order without providing for full and open competition to Becton, Dickinson & Co., DBS BD Biosciences, One Becton Drive, Franklin Lakes, NJ 07417 for the purchase of antibodies required to study the phenotype and functional status of the immune cell populations indifferent physiological compartments during and after pregnancy. Flow cytometry is a powerful and important technique that is utilized daily by the Research Unit in support of our goal to investigate a wide variety of immune cells and their phenotype/function. For this reason, a wide array of antibodies against specific proteins is required to carry out in-depth analysis of immune cells in different compartments. BD Biosciences is the primary choice of contractor for the following reasons: 1) all of the flow cytometer machines currently operated by the Research Unit are from BD Biosciences, and the antibodies and other reagents from BD have all been optimized for use on these machines, thereby reducing the time and expense required to validate antibodies and reagents from other vendors for use in these systems; 2) BD provides the largest catalog of available flow cytometry antibodies, allowing for greater freedom when designing experiments; 3) many of the BD antibodies requested for this purchase have been previously utilized by the Research Unit in other experimental protocols and therefore require less standardization for use in new studies; and 4) due to ongoing business with BD, the Research Unit has received a 30% discounted price for the quoted antibodies. The requested quote includes multiple antibodies in duplicate or higher, depending on the volume of each unit and the required amounts for each experiment. Isotype control antibodies, which are used for comparison during analysis in order to obtain accurate results, are also included.

The intended procurement is classified under NAICS code 325413 with a Size Standard 1250.

REGULATORY AUTHORITY
The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Regulation (FAR) Circular (FAC) 2005-95 effective 19 Jan 2017. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000) and FAR Subpart 12- Acquisition of Commercial Items.

STATUTORY AUTHORITY
This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302- FAR 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1).

This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
