The Naval Air Systems Command intends to negotiate a sole source Indefinite Delivery Indefinite Quantity contract with BAE Systems of Greenlawn, NY for AN/UPX-41(C) Digital Interrogator (DI) production units, Mode 5 change kits to be used to upgrade fielded AN/UPX-37 DI units to the AN/UPX-41(C) configuration, and the attendant technical/logistics support. Estimated quantities to be procured under this contract are as follows: FY 14 Basic Award - approximately 4 AN/UPX-41(C) DI production units, approximately 36 Mode 5 change kits, approximately 3 Mode S change kits and the attendant technical/logistics support; FY 15 Option - approximately 9 AN/UPX-41(C) DI production units, approximately 49 Mode 5 change kits, approximately 35 Mode S change kits and the attendant technical/logistics support; and FY 16 Option - approximately 15 AN/UPX-41(C) DI production units, approximately 61Mode 5 change kits, approximately 55 Mode S Change kits and the attendant technical/logistics support. The Government does not intend to use the provisions of FAR Part 12 for this action. The statutory authority permitting other than full and open competition is Title 10 U.S.C., 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.230-1, only one responsible source and no other supplies or services will satisfy agency requirements.
