The Centers for Disease Control and Prevention, National Center for Environmental Health intends to award a sole source firm-fixed price maintenance agreement to Bruker Scientific, LLC 40 Manning Road Billerica, MA 01821. The Toxins and Flu Group as part of the NCEH's Division of Laboratory Sciences is engaged in research to characterize protein toxins. The group has one Bruker Biotyper MALDI-TOF mass spectrometer, one Bruker Microflex MALDI-TOF and one Bruker Rapliflex MALDI-TOF that are needed for analysis of protein toxins as well as for research and development. The instruments are used for sample detection and to develop new analytic methods. Preventive maintenance and repairs are needed, and the instruments are no longer under manufacturer warranty.

Bruker is the only contractor that has the staff that can provide on-site repair of malfunctioning Bruker mass spectrometers and preventive maintenance in a timely manner with limited interference of operational use. Bruker is the original manufacturer of the equipment and is capable of supplementing their own Field Engineers that can perform the necessary diagnostic compilations to determine the exact corrective methods for problems and repairs. The original equipment warranty information states that the manufacturer only ensures performance at original levels if genuine manufacturer parts or manufacturer trained technicians provide service for equipment that they have previously maintained.

The statutory authority for this sole source acquisition is U.S.C. 2304 (c) (1) in accordance with FAR Part 6.302-1 only one responsible source and no other supplies or services will satisfy the agency requirements.
