NOTICE OF CONTRACT ACTION (NOCA) - The Armament Directorate's Direct Attack Division, Foreign Military Sales (FMS) Program Office (EBDK) intends to negotiate the procurement of 340 GBU-58 Paveway II munitions, as a Firm-Fixed-Price, sole source contract under the authority of FAR 6.302-1 [10 U.S.C.(c)(1)], Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, to Raytheon Company, 1151 E Hermans Road, Tucson, Arizona, 85756-9367. The estimated delivery completion date is 31 December 2016.
The Air Force, AFLCMC/EBDK (Direct Attack Division) requires 340 Paveway II munitions in accordance with an approved FMS Letter of Offer and Acceptance (LOA) case.
This is not a solicitation or request for proposal, nor does it restrict the Government to a specific acquisition approach. The Government intends to solicit and negotiate for the munitions with only one source under the authority of FAR 6.302-1 [10 U.S.C.(c)(1)], Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Submission of any of these documents shall be at the contractor's expense. Capability statements shall demonstrate how the source can provide the GBU-58 Paveway II munition without substantial duplication of costs to the Government or unacceptable schedule delays. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government.
The Life Cycle Management Center (LCMC) has appointed an Ombudsman to hear concerns from potential offerors relating to this acquisition. The Ombudsman does not diminish the authority of the Program Manager or Contracting Officer, but communicates contractor concerns, issues, disagreements, and recommendations to the appropriate Government personnel. When requested, the Ombudsman shall maintain strict confidentiality as to the source of the concern. The Ombudsman does not participate in the evaluation of proposals or in the source selection process. Matters of a routine or administrative nature concerning this acquisition should not be addressed to the Ombudsman, but rather to the Contracting Officer identified. The LCMC appointed Ombudsman:
