This is not a solicitation, but a Notice of Contract Action. The United States Air Force (USAF), Holloman Air Force Base, 49th Contracting Squadron, intends to award a single source Firm-Fixed Price (FFP) purchase order to Spirent Federal Systems. The 746 TS requires maintenance and repairs. IAW FAR 6.302-1(a)(2)(ii), it has been determined, due to duplications of cost associated with an award to a contractor other than Spirent Federal Systems, this will be a sole source acquisition awarded toSpirent Federal Systems. If the government awarded to a new contractor, the new contractor would have to replace all existing Global Positioning Simulators with their own equipment, which would cost substantially more money than the proposed contract. The sole source award is based on proprietary information and technology exclusive to Spirent Federal Systems. Spirent Federal Systems is the sole manufacturer of the simulators currently in place. The simulators were purchased by the Government ten years ago from Spirent Federal Systems and were specifically designed for the U.S. Air Force GPS testing based on the GPS Joint Program Office security requirements. There are no commercial applications of this system. All sofware is proprietary to Spirent Federal Systems. Under the authority of 10 U.S.C. 2304(d)(1)(B) persuant to FAR 6.302-1(a)(2)(ii), awarding the contract to any other source would cause duplication of costs due to the need for any contractor other than Spirent Federal Systems having to remove all of the old equipment previously installed and then install their own equipment. A determination not to compete this proposed contract is based on market research and is solely within the discretion of the Government. This announcement is not a request for competitive quotations. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency, not later than 1:00PM MST, 15 December 2008, referencing F2ETG18311A002, to Gloria Gonzales, Contract Administrator, [email protected]. The government will review all responses, without prejudice, and determine if another firm is capable of fulfulling the Global Positioning Simulator Maintenance requirement.
