The U.S. Nuclear Regulatory Commission (NRC) intends to negotiate a sole source contract with International Business Machines, Corporation (IBM) for specialized software maintenance and upgrade support services for IBM FileNet document management software products to support the agencyÂs Agencywide Document Access and Management System (ADAMS). The items being purchased through this posting with be procured in accordance with FAR Part 12-Acquisition of Commercial Items. The period of performance for this software support is one year. The authority for negotiating on a sole-source basis with IBM is made under the authority of 41 U.S.C 253(c)(1) and Federal Acquisition Regulation 6.302-1, which provides for limiting competition from only one responsible source and no other supplies or services will satisfy the agency requirements. The North American Industry Classification System (NAICS) Code is 541519 (Size Standard: $21 Million). This action is a renewal of NRCÂs maintenance agreement with IBM and is a unique bundle based on NRCÂs licensing needs. This notice of intent is neither a request for proposal nor a solicitation of offers. A determination not to compete this proposed procurement based on responses to the notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities and any other information that demonstrates their ability to meet the NRCÂs needs. Detailed capabilities must be submitted to the above address not later than 10 calendar days from the date this announcement appears in the Federal Business Opportunities. Telephonic responses and responses providing insufficient information for evaluation by the NRC will not be considered.
