This is a notice of intent to issue an order to Radio Networks LLC, 13725 Montfort Dr., Dallas, TX 75240-4455 on a sole source basis under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, 10 U.S.C. 2304(c)(1). This acquisition is for the International Broadcast Rights for Radio Programming, reference Federal Business Opportunity (FBO) posting number HQ0028-09-R-0025, for commercial items (Radio Programming) posted in accordance with the Office of Federal Procurement Policy Memorandum dated 17 Apr 2006, as supplemented with additional information included in this notice. This Government requirement, if solicited, would be advertised as an “unrestricted” procurement with provisions and clauses in effect through Federal Acquisition Circular 2005-32, dated 31 Mar 2009. Contractors must be registered with the Central Contractor Registration (CCR) database (http://www.ccr.gov/) at time award is issued and throughout performance. The proposed procurement is for License Agreement for Network Radio Programming with A B C Radio Network Inc. for the Defense Media Center – Broadcasting (DMC), 23755 Z. Street, Riverside CA 92518, to reproduce, broadcast, and distribute the following radio programming production packages: “Horsepower,” “Avalanche,” “Adrenaline,” “Goldmine,” and “Ambush.” This sole source requirement is for a Base plus 4 option periods that will be solicited from A B C Radio Inc. who is the exclusive rights holder for the International Broadcast Rights for the programs that will be required. This “Notice of Intent” is not a request for competitive offers/quotes/proposals. A determination by the Government to compete this solicitation will be based upon responses to this notice at the sole discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
