Biomerieux maintains sole proprietary rights to providing preventive maintenance and repair services on the BacT/Alert System and incubators. The statutory authority for restricting competition under Simplified Acquisition Procedures, or Single Sourcing, for acquisitions under $150,000.00 or Simplified Acquisition Threshold (SAT) is 41 U.S.C. 253(c), as implemented by FAR 13.106-1(b). This notice of intent is not a solicitation or request for offers. No solicitation package is available. All responsible sources may submit a capability statement. A determination not to compete is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that the responding company can provide preventive maintenance and telephone support for the Biomerieux BacT/Alert System and incubators in accordance with all manufacturer's specifications.
