NAICS Code: 811219 The U.S. Environmental Protection Agency (EPA) Research Triangle Park Procurement Operations Division [RTP-POD] intends to negotiate a sole source purchase order under Simplified Acquisition Procedures to BD Biosciences, 2350 Qume Drive, San Jose, CA 95131, for theacquisition of a 1-year maintenance coverage plan for a specific BD Biosciences Fluorescence Activated Cell Sorter (FACS) Aria II instrument. BD Biosciences has exclusive copyrights, patents, and/or trade secret ownership; and, therefore, is the only vendor that can satisfy the requirement. In order to ensure correct system operation, the circumstance permitting is FAR 6.302-1 "only one source reasonably available". The intent of this notice is to determine if any other source(s) exist. Therefore, no solicitation (RFQ) is available. Consequently, any response failing to demonstrate the contractor's ability to provide maintenance of the system and instead choosing merely to submit a routine letter requesting a copy of the RFQ will be ignored. The information received in response to this notice will be considered solely for determining whether to conduct a competitive procurement.
