Special Notice Notice of Intent to Award a Sole Source Procurement The Department of Veterans Affairs, Veterans Health Administration, Veterans Integrated Service Network (VISN) 17, Network Contracting Office 17, intends to award a firm-fixed priced contract to Becton Dickinson and Company for procurement of the following Cost per Test (CPT) services: 0001: Equipment Maintenance Services, Becton Dickinson FACS Canto II Cell Analyzer, with One (1) Computer Workstation; QTY: 1, Period of Performance: 12 Months 0002: Equipment Maintenance Services, Becton Dickinson FASC Loader QTY: 1, Period of Performance: 12 Months Three (3) One Year Options for all Line Items (TBD) Maintenance coverage includes unlimited on-site services including labor, travel, expenses and parts (excluding consumables); Business Hours Monday thru Friday, excluding holidays, two (2) preventative maintenance services, software revisions and unlimited telephone support during the term. The proposed sole source procurement is being made by a pricing agreement from Becton Dickinson. Becton Dickinson Biosciences provided a sole source letter stating that they do not certify third party organizations to perform service on its instrumentation in the United States and is the only provider of spare or replacement parts. This notice is not to be considered a request for quotations or proposals. No contract will be awarded based on offers received in response to this notice; however, all responsible sources may submit a capability statement, proposal or quotation, which shall be considered by the agency. Proposals or offers received will be used to determine if a comparable source is available and more advantageous to the government. If no affirmative written response is received within 5 days from the publication of this notice, an order will be issued to Becton Dickinson without any further notice. The anticipated statutory authority permitting other than full and open competition for the requirement is 41 U.S.C. 3304(a)(1), as implemented by FAR 8.405-6 Limited Sources.
