NOTICE OF PROPOSED CONTRACT ACTIONS This notice will serve as notification of a Sole Source solicitation for the following: The Department of Chemistry requests a sole-source procurement to continue maintenance service for their Agilent Technologies model G1969A LC/MSD TOF Spectrometer. This system is used in the Department of Chemistry. Agilent Technologies is the original company that designed and manufactured the instrument. This instrument is exclusively controlled by Agilent designed and patented software. The use of this software is proprietary to Agilent Technologies and not authorized for use by any other vendors. This will be a firm Fixed Price contract. This Notice of Intent is not a request for competitive proposals. This is a funded requirement. This procurement is for the acquisition of a sole source commercial item using simplified procedures in accordance with FAR Parts 12 & 13. FAR provisions 52.212-3-Offeror Representations and Certifications - Commercial Items and 52.212-4, Contract Terms and Conditions-Commercial Items apply. In addition, the clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items, apply to this acquisition. Additional FAR clauses cited in the clause applicable to this acquisition are: (b) 14, 15, 16, 17, 19, and 31. DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes of Executive Orders applicable to Defense Acquisitions of Commercial Items, applies to this acquisition.
