Notice of Intent to Sole Source
Under the authority of FAR 6.302, St. Jude Medical, Inc. is the only sole proprietor of this device and no other supplies or services will satisfy VISN 9 requirements. The Department of Veterans Affairs, Network Contract Activity, VISN 9 intends to make a sole source award to St. Jude Medical, Inc.. This product will be used at VAMC - Lexington, KY and will work in conjunction with existing equipment to maintain consistency and agency standardization.
SOLE SOURCE JUSTIFICATION: Under the authority of FAR 6.302, St. Jude Medical, Inc. is the sole proprietor of this device and no other supplies or services will satisfy VISN 9 VAMC - Lexington, KY requirements. Substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency's requirements. Maintenance of this software performed by the proprietor is essential to and has the only solution to meet the agency's requirements at the using service Medical Facility. Further market research and analysis indicates other companies' similar products, or products lacking a particular feature, do not meet, or cannot be modified to meet, the agency's needs. The medical center has found that with this software, the agency can maintain its current standardization requirement and consistency within the medical facility. The government would incur undo substantial cost and risk by using a different vendor that has not been certified and trained by St. Jude Medical, Inc. on the maintenance of the Ensite System. The cost to compete in an attempt to procure different brand name product does not out weight the benefit of maintaining our current standardization and consistency within the agency's operating facilities.
This notice of intent is neither a request for quote nor a solicitation of proposals. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities and any other information that demonstrates an ability to meet the agency's needs.
