The Commodity Futures Trading Commission (CFTC) intends to procure the services of LexisNexis, on a sole source basis, for maintenance of the CFTC's Legislative History Database. The database, which was developed by LexisNexis and is currently being hosted by LexisNexis, contains the statutory history of the agency. One of the primary uses of the database is by the agency lawyers who utilize the database to determine the legislative intent of wording in the statutes. A significant and vital feature of the database is that the documents in the agency history include links to cited information that is contained in LexisNexis's proprietary database, and the agency is able to access those documents via the provided links. The maintenance services will include hosting the database, incorporating new legislative documents into the database, maintaining and updating cited links and correcting any errors that are identified in the database. The anticipated contract will have a base period of performance of one (1) year, and four (4) option years. Based on the procurement history of this requirement, CFTC believes that award to any other source would result in substantial duplication of cost to the Government for development of the database by a new contractor. This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the date and time identified above. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of the CFTC.
