DESCRIPTION:
The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Lumerical Solutions, inc of Vancouver, Canada for the purchase of renewal concurrent Network based licenses for Lumerical's non-commercial FDTD solutions software. This will be under other than full and open competition by the authority of FAR 13.106(b)(1). Only one responsible source and no other supplies or services will satisfy agency requirements:
A sole source determination is based on the following: Only Lumerical Solutions, inc. can meet our technical requirements.
Specifically no other vendor can meet the NIST requirements for: Lumerical
renewal concurrent network based licenses for Lumerical's non-commercial FDTD solutions software.
NIST is the user of the software from Lumerical since 2008. The software is Lumerical proprietary and is available only from Lumerical Solutions, Inc. Lumerical is the only supplier of the licenses required for the operation of their software.
There are no other re-sellers.
The North American Industry Classification System (NAICS) code for this acquisition is 511210, and the size standard is $35.5 mil.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on February 26, 2014. Inquiries will only be accepted via email to [email protected]. No telephone requests will be honored.
