The Directorate of Contracting (DOC), Fort Campbell, KY, has a requirement for replacement products (i.e., pouches, panels, adapters, straps) required for use with the Aircraft Ballistic Armor Vests. The procurement will be conducted on a sole source basis in accordance with the statutory authority of the test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996) as implemented by FAR 13.501. The Agency intends to enter into a firm-fixed-price, supply-type contract with Eagle Industries Unlimited, Inc., located in Fenton, Missouri. The basis for restricting competition is the proprietary rights of Eagle Industries Unlimited, Inc. The CIACS-6-CIRAS replacement products are required for use with the Aircraft Ballistic Armor Vests. The replacement products manufactured by Eagle Industries must be compatible with the vests manufactured by Eagle Industries and used by the 160th SOAR. This is a modular system that affords complete latitude and tailor ability to the Aircrew members. 44 pouches, panels, and adapters are included in the kit currently used by U.S. Special Operations Forces. All body armor and load carriage systems currently issued to these forces in use in the Global War on Terrorism are made by Eagle Industries. All battle gear utilized in the aircrew kit is exactly that of all the other kits above and is battle tested. The entire Aircrew kit was originally designed specifically for the 160th with over four years Developmental and operational testing. The vests and its 44 pouches/panels are manufactured by Eagle Industries Unlimited. These are the only known products that meet the needs and requirements of the 160th SOAR. Requirement is for unique equipment available from only one source with unique capabilities. NAICS code for this procurement is 339999 and the small business size standard is 500 employees. This sole source requirement will be procured under Simplified Acquisition Procedures and Other Than Full and Open Competition, and awarded on an unrestricted basis. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE OFFERS and solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer within 14 days from the date of the publication of this synopsis. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion for the Government. If no responses are received, the Government will proceed with the sole source negotiation with the manufacturer, Eagle Industries Unlimited. Responses are due by 14 September 2009, 4:00 p.m. (CT).
