THIS IS A NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. The intent of this Special notice is for informational purposes only. The USDA-ARS-Lexington, KY intends to award a sole source procurement to Waters Technologies Corp, 34 Maple Street, Milford, MA 01757 pursuant to the authority of 41 U.S.C 253(c)(1) and FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will satisfy Agency Requirements. The award will be for support and maintenance of a Waters UPLC Mass Spectrometer with Triple- Quadrapole Detector, UPCL Sample manager, UPLC Binary Solution Manager and MassLynx software updates. The maintenance agreement will provide preventive maintenance, service maintenance, replacement parts and software updates. The UPLC Mass Spectrometer with Triple-Quadrapole Detector is manufactured by Waters Technologies, which is used in the qualification and quantification of compounds and toxins in extremely low concentrations in plant and animal tissues. The maintenance, repair and software updates to the instrument will require trained Waters technicians who have specialized knowledge to exchange the parts and conduct the PM'S on-site. The Government intends to award a firm fixed price Purchase Order for the service agreement on or about May 23, 2017, using Simplified Acquisition Procedures. This Notice of Intent is not considered a Request for Quotation (RFQ) nor is it a Request for Proposals (RFP). No solicitation document is available and telephone requests will not be honored.

Interested persons may identify their interest and capability to respond to this requirement. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. The government will consider all responses received by 12pm CST, May 22, 2017. Information received will be considered solely for determining whether to conduct a competitive procurement. If no written responses are received after the publication of this notice, the purchase will be awarded without further notice.
