The National Institute of Standards and Technology (NIST)/Acquisition Management Division (AMD), intends to negotiate on a sole source basis, on behalf of the NIST/ Surface and Microanalysis Science Division, with FEI Company, of Hillsboro, Oregon, for a service contract for a commercial aberration-corrected, monochromated analytical electron microscope to meet project needs. This microscope, the FEI Titan⢠80-300, Serial Number D3094, is a Transmission Electron Microscope/Scanning Transmission Electron Microscope (TEM/STEM).
The period of performance will be for a one year with four one year option periods.
The Contractor shall provide a service agreement for the service and maintenance of the Titan and its associated components to ensure uninterrupted performance within manufacturersâ specifications on a scheduled and as-needed basis.
Service and maintenance shall include unlimited emergency visits during regular business hours in addition to scheduled preventive maintenance visits. Covered expenses shall include all parts, labor, travel, and per diem.

FEI has proprietary rights to the technology which governs the hardware and software. FEI Company guarantees the full system performance of the instrument, including third-party accessories, if these components have been purchased through FEI and are covered under an FEI Warranty or Service Contract.
FEI is responsible for the sale, installation, training, and testing of the instrument to ensure it meets all required performance specifications.
No other vendor possesses the knowledge to provide the required service and maintenance. No other vendor has rights to FEIâs proprietary hardware and software. FEI has no distributors.
The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is $6.5 Million.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by May 30, 2008, will be considered by the Government.
A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
