Commerce has a statutory responsibility to review proposed acquisitions of U.S. business by foreign persons for national security purposes, pursuant to Section 721 of Title VII of the Defense Production Act 1950, as amended 50 U.S.C App 2170 as member of the interagency Committee on Foreign Investment in the United States (CFIUS). The Office of Trade and Economic Analysis (OTEA) , a part of the Industry & Analysis division of the International Trade Administration coordinates and leads Commerce's engagements in CFIUS. OTEA provides analysis on the economic impacts of the transaction under review, including conducting research that the Secretary of Commerce is required to conduct.
