The proposed contract action is for an acquisition for which the DLA Distribution Acquisitions (J7), 2001 Mission Dr., New Cumberland PA 17070 intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b)(1) for the renewal of Micro Focus annual software maintenance license.

This acquisition is being restricted to Micro Focus, Inc., 700 King Farm Blvd Ste 400, Rockville MD 20850 in accordance with the authority under FAR 13.106-1(b)(1). Only Micro Focus Inc. is the only authorized source to renew annual software maintenance for Micro Focus Software.

Justification for Sole Source to Micro Focus, Inc.:
DLA Distribution Acquisitions (J7), 2001 Mission Drive, New Cumberland PA 17070 has a requirement to renew the Micro Focus Server Enterprise Edition Software Support for use by DLA Information Operations located at Ogden, UT and deployed with the DLA Distribution Expeditionary Depot.

The annual license renewal authorizes the Federal Government to use the Micro Focus software and allows Micro Focus to provide software support, upgrades, and software patches for issues and problems identified by their commercial customers and by the public sectors that use the software. Micro Focus makes the final determination which technical issues or problems that require fixing through updating code or issuing new software patches..
The Micro Focus Enterprise Server Software is used for On-Line Transaction Processing (OLTP) for the Distribution Standard System (DSS) deployed with the DLA Distribution Expeditionary Depot. Without the Micro Focus software, the Expeditionary Depot will not be able to communicate with other DLA Distribution Main Frame systems using the same code.

The cost associated with acquiring new software capable of performing the same function is cost prohibitive due to the amount of code rewriting in the Expeditionary Depot DSS as well as other main frame systems deployed throughout DLA Distribution, testing of any new code prior to deployment of the new software, and training personnel on the new software. The Government runs the risk that the new software will not work with existing Micro Focus software on other DSSs and additional software or hardware would be required to facilitate any new software deployment.

The Expeditionary Depot can be deployed worldwide at any time and the transition process for implementing the new software in testing or code rewriting will hinder the depot and DLA in meeting its mission.
Micro Focus requires all maintenance contracts be renewed directly through Micro Focus.

This acquisition is being restricted to Micro Focus, Inc. pursuant to FAR 13.106-1(b)(1); only one source reasonably available due to only Micro Focus, Inc. can renew the annual maintenance licenses for the software.

Interested contractors may identify their interest and capability to respond to the requirement or submit proposals. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

The North American Industry Classification System (NAICS) code for this effort is 511210 with a small business size standard of $25,000,000.
