DESCRIPTION:

The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Anasys Instruments Corporation of Sanata Barbara, CA for the purchase of an NanoIR instrument upgrade under other than full and open competition by the authority of FAR 13.106 (b)(1). Only one responsible source and no other supplies or services will satisfy agency requirements:

A sole source determination is based on the following: Only Anasys Instruments Corporation can meet our technical requirements.

Specifically no other vendor can meet the NIST requirements for:

Upgrade to an Nano IR instrument.

CNST requires the following items to significantly upgrade the capabilities of our nanoIR instrument: Tapping mode upgrade, Conductive Atomic Force Microscopy (AFM) upgrade, AND the Lorentz Contact resonance AFM upgrade. The required upgrades are necessary for research in plasmonic and solar cells applications. The compatibility of the upgrade with the existing unique hardware and software can only be ensured if the upgrade is performed by Anasys Instrument. Anasys Instruments has the patent protection for their IR imaging technology and their thermal analysis technology used in the nanoIR instrument installed at NIST. The required upgrades improve the functionality and capabilities of the nanoIR unique instrument relaying on their patent protection technology.

Anasys Instrument does not license or certify any other vendor to perform modification, maintenance or upgrade on the NanoIR instrument and to comply with the warranty, the NanoIR instrument upgrade must be provided by Anasys Instrument.

There are no other re-sellers.

Anasys Instruments Corporation is the sole distributor of the upgrade.

Delivery shall be FOB Destination, Gaithersburg, MD.

The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees.

No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on June 19, 2013. Inquiries will only be accepted via email to [email protected]. No telephone requests will be honored.

A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
