The USAF Academy has a Brand Name Only requirement to purchase the Nihon Kohden polysomnogram (Polysleep-921-1) and associated equipment and accessories. The 10th Medical Group has determined this to be the only product that meets all its required features and functionality based on the following justification.
The Neurology Department at the USAF Academy Clinic has a requirement to equip two new sleep rooms with polysomnogram equipment and associated software and accessories. The only acceptable brand is manufactured by the Nihon Kohden Company. It is essential for the Neurology Department to maintain software and amplifier compatibility for data retrieval and utilization. No other brand will allow data interoperability, functionality and sharing among the six sleep rooms. In addition, the Tricare network and local private practice neurologists use Nihon Kohden amplifiers and software to perfom sleep studies. Utilization of a different brand would prevent access to sleep data mandated by Tricare.
This notice document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-32, 31 Mar 09. The North America Industry Classification System Code [NAICS] is 334510 and the size standard is 500.

A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. All sources believing they have an equal product may submit a response, which if timely received, will be considered by this agency. Respondents must provide a product equal to the Nihon Kohden Polysleep-921-1. Responses must be received NLT 1600 (MST) on 25 June 2009. Responses received after this will be considered late IAW FAR 52.212-1(f) and will not be evaluated.

5352.201-9101 OMBUDSMAN (AUG 2005)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
