DESCRIPTION: The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 6.302-1, with The University of Kentucky for the acquisition of 4 million Standard Reference Material (SRM) 1196 cigarettes.
***** Sole source determination for this procurement is based on meeting the specific requirements of the SRM 1196 cigarettes. The SRM 1196 shall have the same physical specifications of the current test cigarette. This particular cigarette has been selected because early data indicates the SRM 1196 has the highest ignition propensity of any test cigarette examined. The Consumer Products Safety Commission's federal standard for mattresses and mattress pads (16 CFR part 1632), upholstered furniture (16 CFR part 1634), and flammability standard for cellulose insulation (16 CFR part 1209) all require the use of the SRM 1196 cigarettes. The University of Kentucky has been identified as the only vendor capable of meeting this requirement. No other manufacturers, distributors, or re-sellers have been identified.
*****The North American Industry Classification System (NAICS) code for this acquisition is 611310 - Colleges, Universities and Professional Schools, with a small business size standard of $27.5 M.
******A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
*****No solicitation package will be issued. This notice of intent is not a request for competitive quotations. Interested parties that believe they can satisfy the requirements listed above must identify their capability in writing before the response date of this notice. Only responses received by July 5, 2016, 12:00 p.m., EST will be considered by the government.
