The Clinical Center, Critical Care Medicine Department intends to award a sole source Purchase Order to INO Therapeutics LLC dba Ikaria DUNS # 090546628 for the period of performance of January 1,2013 through December 31, 2013. The order will result in a firm fixed price Purchase Order for INO Therapeutics LLC for the purchase of nitric oxide gas to support patients at the Clinical Center, the order is for service for which the Government intent to solicit and negotiate with only one sole source under the authority of FAR 6.302-1 and the Titles 10 U.S.C. 2304 (c)(1) . Only one Responsible Sources and No Other supplies or Services will satisfy Agency Requirements. Negotiation being conducted using other than full and open competition procedures pursuant to authority of FAR 6.3012-1. Responsible source may submit a capability statement, proposal, or quotation which shall be considered by the agency.

This notice of intent is not a request for competitive proposals. The Government will not be responsible for any cost incurred in preparation of statements, proposal,or quotations. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation or additional information will be made available with regards to this sole source notice.

This is a notice of intent to award a sole source purchase order and is not a request for competitive proposals to satisfy agency requirement. The government intends to solicit a quote and enter into a firm fixed price with INO Therapeutics LLC., DUNS# 090546628 for the continue utilization of Nitric Oxide Gas that provides state-of-the-art supportive critical care to the critically ill patients in the intensive care unit. The usages of this gas is entirely dependent on the critical condition of the various patient s meeting implementation criteria, therefore, usage duration cannot be anticipated. INO Therapeutics LLC dba Ikaria is the sole source provider of nitric oxide gas. This is the only company approved in the United States of America by the Food and Drug Administration as a supplier of the this gas.

Small businesses are encouraged to respond to this notice if they are capable to meet the needs of this requirement. Written responses to this notice shall contain sufficient documentation to establish bonafide capability and compatibility to fulfill the requirement. A schedule list is attached to the solicitation for examination if the need can be met.

The intended procurement will be classified under North American Industry Classification System Code 325411, with the size standard # of employees of 750. The requirement is being processed in accordance with the simplified acquisition procedures as stated in FAR 13.106-(b)(1).

The Government shall consider all responses received prior to the close date of this announcement. All responses must be received no later than January 31, 2013, 12:00PM, eastern standard time.
