Notice of Intent to Award a Sole Source Contract

DLA Distribution intends to award a contract to manufacture and install eight (8) right and left Hyster-Yale joystick controllers for Hyster-Yale equipment located at DLA Distribution Susquehanna, PA on a sole source basis to Eastern Lift Truck, LLC. In accordance with FAR 6.203-1 “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and FAR 13.106-1(b) “soliciting from a single source for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit form one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.”

Hyster-Yale Group (Hyster-Yale) is the original equipment manufacturer (OEM) of the equipment and has proprietary rights to the equipment and replacement parts that the service will cover. Hyster-Yale authorizes service representatives by region. Eastern Lift Truck, LLC (Eastern Lift) is the authorized service representative for the New Cumberland, PA area. Using any other vendor would nullify the current warranty on the Hyster-Yale equipment. In addition, other vendors would not be able to supply the necessary Hyster-Yale controller assembly. Award to another source for this procurement would result in a substantial duplication of cost to the government that is not expected to be recovered through competition.

Interested contractors may identify their interest and capability to respond to the requirement or submit proposals. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

The North American Industry Classification System (NAICS) code for this effort is 336330 with a small business size standard of 1,000. PSC Code is 2530.

This notice of intent is not a request for competitive proposals. This synopsis is for informational purposes only. A solicitation will not be issued for this procurement action or posted to the single Government Point of Entry, the betaSAM.gov website.

If no affirmative responses are received, a purchase order will be awarded to Eastern Lift Truck, LLC.
