Notice of Intent to Award Sole Source, Elsevier BV Non-Patent Literature Subscription

The United States Patent and Trademark Office (USPTO), Scientific and Technical Information Center (STIC), hereby announces its intent to award a contract to Elsevier B.V., dba: North-Holland (Publishing), Radarweg 29, Amsterdam 1043 Netherlands, on a sole source basis utilizing FAR 15, Contracting by Negotiation, FAR 12 Acquisition of Commercial Products and Commercial Services, and in accordance with 41 USC 1901 (e)(2) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The NAICS code for this acquisition is 513120, Periodicals Publishers, with a size standard of 1000 employees.

The USPTO requirement is for a site license for Elsevier BV Subscription: eJournals, eBooks, & Knovel Database. The contractor shall provide a site license to acquire access to Elsevier B.V.’s collection of electronic full-text electronic collections of journals, books and engineering reference database.  Period of Performance will include a base period of 1/1/2025 – 12/31/2025 with up to 4 option years.

This is not a request for competitive quotations; however, the Government will review any product, capabilities, and quotes submitted prior to the closure of this notice. Responses must be supported with clear and convincing evidence to clearly be able to provide the services outlined in this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
