Special Notice - Notice of Intent to Sole Source

U.S. Army Corps of Engineers, Portland District intends to negotiate/award a sole source, firm-fixed-price, non-personal, commercial service contract to the Confederated Tribes and Bands of the Yakama Nation at 401 Fort Rd, Toppenish WA 98948. The purpose of these acquisitions are as follows:

            1. FY 21 Yakama Nation Federal Columbia River Power System (FCRPS) Beacon Rock TCP Inventory.

            2. FY 21 Federal Columbia River Power System (FCRPS) Yakama Nation Determinations of Eligibility for Sites Associated with Coyote’s Journey The Dalles Project, Klickitat County, Washington

            3. FY 21 The Confederated Tribes and Bands of the Yakama Nation (Yakama Nation) to gather information that can assist in the development of long-term cultural resource management decisions.

   4. FY 21 The Confederated Tribes and Bands of the Yakama Nation (Yakama Nation) for technical services to support the Federal Columbia River Power System Cultural Resources Program, Wana Pa Koot Koot.

The U.S. Army Corps of Engineers (Corps) and the Bonneville Power Administration (BPA) (Agencies) are jointly responsible for compliance with Section 106 of the National Historic Preservation Act (NHPA) under the terms of the 2009 Systemwide Programmatic Agreement (SWPA) for management of historic properties affected by operations of the Federal Columbia River Power System (FCRPS). The Corps, Portland District, manages the Bonneville, The Dalles, and John Day Projects, which are part of the FCRPS. The FCRPS Cultural Resource Program works closely with interested and affected tribes, state historic preservation offices (SHPOs), and other agencies for cultural resource management in compliance with Section 106 of the NHPA. 

This acquisition is for the contribution of traditional knowledge and input from the Yakama Nation as part of assisting the Corps with National Historic Preservation Act Section 106 and 110 compliance. These services are for identifying traditional cultural properties, also known as historic properties of religious and cultural significance to Indian tribes in Bonneville Pool. These inventories assist the Corps in the development of long-term cultural resource management decisions

The statutory authority for this non-competitive acquisition is 41 U.S.C. 1901(e) as implemented by FAR 13.106-1 Soliciting Competition (b) soliciting from a single source.

A solicitation will not be posted as the Government intends to proceed with this sole source action. The NAICS code is 541990 – All Other Professional, Scientific, and Technical Services. The size standard as defined by the U.S. Small Business Administration is $16,500,000.00.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement to the contracting officer before the notice end date. If no affirmative electronic responses are received by 12:00 PM Pacific Daylight Time on 15 August 2021, an award will be made without further notice. Electronic responses and questions shall be submitted via email to the contracting POC listed below. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
