INTRODUCTION

THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION.

The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), intends to negotiate and award a purchase order on a noncompetitive sole source basis to University of Maryland Medical System, 250 W Pratt Street Suite 2400, Baltimore, MD 21201-1544, to procure oral and maxillofacial surgery services for a patient in a NHLBI clinical protocol.

BACKGROUND

The doctors who comprise the University of Maryland Oral and Maxillofacial Surgery Associates (UMOMSA) are among a select few individuals known nationally and internationally as leaders in their specialty due to their reputations as excellent surgeons, well-established researchers, national and international orators, and quality patient care providers. All of the UMOMSA surgeons are board certified by the American Board of Oral and Maxillofacial Surgeons (ABOMS). These doctors have had teaching experience at a variety of institutions throughout this country and abroad. The UMOMSA Faculty Practice office complex is located at 650 W. Baltimore Street, Suite 1401, one block from the University of Maryland Medical Center. The office is equipped with the state-of-the-art equipment for diagnosis and outpatient treatment, with both local and general anesthesia. The UMOMSA group of surgeons is on staff at both the University of Maryland Medical System and the University of Maryland, Baltimore Dental School. These affiliations allow these doctors make full use of consultation services from both physicians in the hospital, as well as dental specialists in the dental school, if necessary.

PURPOSE

NHLBI's Office of the Clinical Director requires the services of a qualified oral and maxillofacial surgeon who can perform an operation for an NHLBI clinical trial patient. This particular patient has had this surgery previously at the University of Maryland and has unfortunately developed complications relating to this surgery. In order to correct this serious issue, another surgery is required.

PROCUREMENT

The contractor shall provide the following:

• Oral and Maxillofacial Surgery for one patient within an NHLBI clinical protocol

JUSTIFICATION

The sole source determination is based on the fact that the surgeon who performed the first surgery on this patient is an employee of the University of Maryland Medical Center. For the health and safety of the patient, plus the validity of the clinical trial, it is imperative that the same surgeon perform this surgery.

REGULATORY AUTHORITY

This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b), soliciting from a single source (for purchases not exceeding the simplified acquisition threshold) and only one responsible source and no other supplies or services will satisfy agency requirements.

ADDITIONAL INFORMATION

Industry Classification (NAICS) Code is 541990, All Other Professional, Scientific, and Technical Services, and the Small Business Size Standard is $15.0M. The acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, therefore the requirements of FAR Part 6, Competitive Requirements, are not applicable (FAR Part 6.001). The resultant award will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-89 (August 15th, 2016).

This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
