Title: Portugal Performing Rights - License to use copyrighted musical works in the repertory of
the contractor.
INTRODUCTION:
This is a Sources Sought to determine the availability and technical capability of small
businesses (including the following subsets, Small Disadvantaged Businesses, HUBZone Firms;
Certified 8(a), Service-Disabled Veteran-Owned Small Businesses and Woman Owned Small
Business) to provide the required products and/or services.
Description(s):
The objective of this requirement is to acquire a follow on licensing and support agreement. This
contract is for the acquisition by the Defense Media Activity, Contracting Office, in support of the
American Forces Network - Broadcast Center (AFN-BC), hereinafter referred to as the
"Government", of a license agreement to use and perform copyrighted musical and dramatic works
represented by Societe Belge Des Auteurs, Composituers (SABAM), hereinafter referred to as the
"Contractor", for the period specified within this contract.
2. LICENSE
The Defense Media Activity (DMA) is seeking authorized sources to acquire a follow on licensing
and support agreement for the Inc. Portugal Performing Rights - License to use copyrighted
musical works in the repertory of the DoD audience service overseas in support of The American
Forces Network (AFN) is chartered with providing news and entertainment to both the primary
AFN audience of DoD personnel stationed overseas, DoD civilian employees and their family
members. It is also required to ensure the accomplishment of the AFN mission to effectively
communicate command information to DoD personnel stationed overseas, DoD civilian employees
and their family members, while simultaneously providing the level of entertainment needed to
make a positive impact on their morale. It will provide the most efficient and furthest reach to
ensure effective communication of information messages inserted within the programs as spot
announcements in support of DoD internal information themes, goals and objectives.
CLIN 0001 (Base Period): The contractor shall provide, Performing Rights - License to use copyrighted
musical works in the repertory.and shall include coverage of national and international news events,
hourly news report services, news bulletins, sports reports, national weather forecasts, and
feature services to Authorized American Forces Radio and Television Services/American
Forces Network (AFRTS/AFN) Outlets.
License Period - April 1, 2018 through March 31, 2019.
CLIN 1001 (Option Year 1): The contractor shall provide, Performing Rights - License to use
copyrighted musical works in the repertory and shall include coverage of national and international
news events, hourly news report services, news bulletins, sports reports, national weather
forecasts, and feature services to Authorized American Forces Radio and Television
Services/American Forces Network (AFRTS/AFN) Outlets. Attached Statement of Work
(SOW).
License Period -April 1, 2019 through March 31, 2020.
CLIN 2001 (Option Year 2): The contractor shall provide, Performing Rights - License to use
copyrighted musical works in the repertory and shall include coverage of national and international
news events, hourly news report services, news bulletins, sports reports, national weather
forecasts, and feature services to Authorized American Forces Radio and Television
Services/American Forces Network (AFRTS/AFN) Outlets.
License Period - April 1, 2020 through March 31, 2021.
CLIN 3001 (Option Year 3): The contractor shall provide, Performing Rights - License to use
copyrighted musical works in the repertory and shall include coverage of national and international
news events, hourly news report services, news bulletins, sports reports, national weather
forecasts, and feature services to Authorized American Forces Radio and Television
Services/American Forces Network (AFRTS/AFN) Outlets.
License Period - April 1, 2021 through March 31, 2022.
CLIN 4001 (Option Year 4): The contractor shall provide, Performing Rights - License to use
copyrighted musical works in the repertory and shall include coverage of national and international
news events, hourly news report services, news bulletins, sports reports, national weather
forecasts, and feature services to Authorized American Forces Radio and Television
Services/American Forces Network (AFRTS/AFN) Outlets.

REQUIRED CAPABILITIES:
The Contractor hereby grants to the Government, its officers, agents, employees and servants, to the full
extent of its present and future power to do so, an irrevocable, non-exclusive, non-transferable paid-up
license to reproduce, arrange, translate, abridge, recast, deliver, dramatize, perform, or use through any
media, including but not limited to radio, television, internet streaming, phonograph, motion-picture, and
wired-sound systems; and in person, in public or private, in any visual or audible manner, any and all of
the literary, dramatic, musical, and artistic works, in the Contractor's repertoires during the life of this
agreement, which the Government is not otherwise licensed to use.

SOURCES SOUGHT:
The anticipated North American Industry Classification System Code (NAICS) for this
requirement is 512120, with a size standard of 32 Mil. This Sources Sought Synopsis is
requesting responses to the following criteria ONLY from small businesses that can provide the
required services under the NAICS Code.
To assist DMA in making a determination regarding the level of participation by small business
in any subsequent procurement that may result from this Sources Sought, you are also
encouraged to provide information regarding your plans to use joint venturing (JV) or partnering
to meet each of the requirements areas contained herein. This includes responses from qualified
and capable Small Businesses, Small Disadvantaged Businesses, Service Disabled-Veteran
Owned Small Businesses, Women-owned Small Businesses, HUBZone Small Businesses, and
8(a) companies. You should provide information on how you would envision your company's
areas of expertise and those of any proposed JV/partner would be combined to meet the specific
requirements contained in this announcement.
In order to make a determination for a small business set-aside, two or more qualified and
capable small businesses must submit responses that demonstrate their qualifications. Responses
must demonstrate the company's ability to perform in accordance with the Limitations on
Subcontracting clause (FAR 52.219-14).
SUBMISSION DETAILS:

1) Business name and address;
2) Name of company representative and their business title;
3) Type of Small Business;
4) Cage Code;
5) Contract vehicles that would be available to the Government for the procurement of the
product and service, to include ENCORE II, General Service Administration (GSA), GSA
MOBIS, NIH, NASA SEWP, Federal Supply Schedules (FSS), or any other Government Agency

6) Certification that the vendor is an authorized provider of these services including technical
software and hardware support through Tribune Media Services.

submit a brief capabilities statement package (no more than five pages) demonstrating ability to
perform the services listed in this Technical Description. Documentation should be in bullet
format.

information received that is marked Proprietary will be handled accordingly. Please be advised
that all submissions become Government property and will not be returned. All government and
contractor personal reviewing RFI responses will have signed non-disclosure agreements and
understand their responsibility for proper use and protection from unauthorized disclosure of
proprietary information as described 41 USC 423. The Government shall not be held liable for
any damages incurred if proprietary information is not properly identified
