REGULATORY AUTHORITY
The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-84, September 3, 2015. This acquisition is conducted under 41 U.S.C. 1903, the simplified acquisition procedures authorized in this subpart may be used for acquisitions that do not exceed $13 million when the acquisition will be treated as an acquisition of commercial items in accordance with 12.102(f)(1).
STATUTORY AUTHORITY
This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplifeid Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements.
This notice of intent to award is not a request for competitive quotations. Interested concerns capable of providing the same or similar products or services as described in this notice may submit a capability statement outlining their capabilities. No solicitation is available. Information received will be evaluated for the purpose of determining whether to conduct a competitive procurement. Capability Statements must be received within the time set forth in this synopsis to be considered by the Government. A determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.

Title
Proficiency Testing for Accreditation
Background Information:
The Department of Laboratory Medicine is in need for The College of American Pathologist (CAP) Proficiency Testing materials which are required in order to fulfill the laboratory's accreditation requirements. CAP surveys provide the opportunity for the peer group comparisons that are shared by more than 6,000 laboratories worldwide. Proficiency testing materials will be shipped to Lab Medicine throughout the year to assess DLM testing performance. CAP is the only vendor which provides Proficiency Testing orders include PT material, and complete evaluation criteria with each participant summary booklet, offering peer's comparisons and opportunities for continuing education resources to the laboratory. Our CAP accreditation covers one CLIA number for the laboratory that performs 2,012,476 tests per year. CAP requires that we be enrolled in a PT program that covers the complexity of our lab. This program is needed for inspection and accreditation compliance and does not include proficiency testing. Scope of service covers the following areas: Chemistry, Hematology, Molecular Hematology, Microbiology, Molecular Microbiology, Flow Cytometry and Molecular Genetic.
If Department of Laboratory (DLM) accreditation is affected by a failure to fully participate in the CAP proficiency testing program, DLM would be forced to suspend testing and NIH CC patients could stand the risk of not receiving the best possible laboratory testing outcome.
CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION
The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. The subject award will be a continuation to previous testing conducted by the subject contractor.
CLOSING STATEMENT
This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov."
A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
