The Department of Veterans' Affairs, James A. Haley Veteran's Hospital (JAHVH) located in Tampa, FL intends to solicit and negotiate a sole source contract with Myriad Genetic Laboratories to provide BRACAnalysis testing for the assessment for hereditary risk of breast cancer. The authority permitting other than full and open competition for this procurement is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirement. The BRACAnalysis diagnostic breast cancer test is used to detect mutations in the BRAC1 and BRAC2 genes. Myriad Genetic Laboratories offer the most sophisticated technology available for hereditary cancer syndromes and is the sole provider of the BRACAnalysis diagnostic breast cancer test. Myriad sequences both genes to detect mutations which significantly increase the risk of cancer in mutation carriers. The NAICS Code is 621511 and the Small Business Size standard is $13.5M.
The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate under the authority of FAR 6.302.1. Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive quotes; however, any firm that believes it can meet the requirements may give written notice to the Contracting Officer by 2 p.m. EST, June 15, 2009. Supporting evidence must be furnished in sufficient detail to demonstrate the capability of the firm to provide the specific BRACAnalysis test. Evidence provided will be used solely for the purpose of determining whether to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
