The American Recovery and Reinvestment Act of 2009 (ARRA, or Recovery Act) (Pub. L. 111-5) was signed into law on February 17, 2009. The law includes the Health Information Technology for Economic and Clinical Health Act (HITECH Act), which established programs to provide incentive payments for the "meaningful use" of certified electronic health record (EHR) technology. Included in these incentive payments (also known as HITECH payments) are payments to Medicare hospitals.
The purpose of this modification is to fund the contractor to collect and subsequently enter necessary data into the HITECH FISS screens for all Subsection (d) Hospitals by March 31, 2011.
This contract action was not awarded as a fixed price type because uncertainties involved in contract performance did not permit costs to be estimated with sufficient accuracy to use any type of fixed price contract. As such, a cost-reimbursement type action was awarded (FAR 16.301-2).
