NOTICE OF INTENT TO SOLE SOURCE Synopsis: This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." Due to the commercial nature of this item, the publicizing and response time is set to afford potential offerors a reasonable opportunity to respond in accordance with FAR 5.203(b).
The U.S. Army Corps of Engineers, Portland District intends to award a sole-source, firm-fixed-price commercial supply contract to North Coast Electric Company, 625 N Thompson St, Portland, Oregon 97227-1820. The purpose of this acquisition is to procure the following software licenses: RSLogix 5 License, RSLogix 500 License, and RSLogix 5000 License. The publisher/developer of these licenses is Rockwell Automation, Inc. These licenses support the Allen-Bradley family of programmable controllers. The RSLogix licenses are essential to maintain and update the current Programmable Logic Controllers (PLC) in the field. North Coast Electric Company is the only authorized distributor of the RSLogix licenses in the Portland, OR area.
The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304(c)(1) as implemented by FAR 13.106-1(b)(1) - Soliciting from a Single Source for purchases not exceeding the simplified acquisition threshold.
A SOLICITATION WILL NOT BE POSTED The Government intends to proceed with this sole source action. The NAICS code is 511210 - Software Publishers. The size standard as defined by the U.S. Small Business Administration is $38,500,000 employees.
THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government by submitting a capability statement that they are an authorized distributor for Rockwell Automation/Allen-Bradley RSLogix, or distributer of a product that is equivalent to RSLogix and Allen-Bradley family of programmable controllers. If no affirmative written responses are received by 2:00PM Pacific Time on 16 May 2019, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
