This is a Notice of Proposed Contract Action under the FAR Part 12 Acquisition of Commercial Products and Commercial Services and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 334515 (Instrument Manufacturing for Measuring and Testing Electricity and Electrical Signals) with a small business size standard of 750 employees.
The Government requires the procurement of various pieces of test equipment including signal generators, a signal analyzer, and digital multimeters, and intends to negotiate a sole-source award for this requirement with Keysight Technologies, Inc., 1900 Garden of the Gods Rd., Colorado Springs, CO 80907-3423. The applicable Keysight part numbers and associated descriptions for the required pieces of test equipment are as follows:

The Government has determined that other companies' products do not meet or cannot be modified to meet the Government's needs. All of the required test equipment pieces under this current requirement are intended to be integrated into/used with an existing test system that is comprised of Keysight branded equipment. Specifically, the Government already owns and is using Keysight branded Signal Generators and Spectrum Analyzers similar to those being procured under this current requirement. Obtaining new Signal Generators and Signal Analyzers that are of the same brand as those currently in place and being used both allows for simplicity of installation and ensures compatibility with existing test infrastructure. Moreover, use of a common brand of test equipment reduces overall risk by guaranteeing interoperability and digital communication. Introduction of a different brand of test equipment to the existing setup increases the risk of the new equipment being incompatible for the complex tasks required under the ongoing project for which this equipment will be used.
While Keysight Technologies, Inc. does maintain a network of authorized resellers for its products, market research has yielded that Keysight Technologies, Inc. direct is offering the Government a greater than usual discount for this particular requirement, which will not be passed onto authorized resellers. Accordingly, as aforementioned, the Government intends to award a sole-source contract for this requirement to Keysight Technologies, Inc. direct.
This is a notice of proposed contract action and not a request for competitive proposals; however, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. All inquiries should be sent by email to [email protected]. Responses must be submitted by the date/time listed on the notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 30 April 2024.
A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation.
