The Commodity Futures Trading Commission ("CFTC" or "Commission") intends to award a sole source contract to Nexidia, Inc., 3535 Piedmont Road, NE, Atlanta, GA, for a follow-on contract to provide software maintenance and additional licenses for Nexidia Enterprise Speech Intelligence (ESI) software and related modules. ESI software is a proprietary product of Nexidia. The contract will also include consulting services for Nexidia software applications. Nexidia is the only known source for these products and services. The contract will have one base year commencing on March 26, 2014 and four option years. This procurement is conducted under the procedures of FAR Part 12, Acquisition of Commercial Items. This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the response date and time identified in this synopsis. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source contract described in this notice, and such determination shall be made at the sole discretion of CFTC.
