This procurement is being conducted in accordance with  Federal Acquisition Regulation (FAR)  6.302-1 (a)(See statutory authority 41 U.S.C. 253(c)(1).

The property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency. 

And

6.302-1(ii) (See statutory authority  41 U.S.C. 253 (d)(1)(B).)

Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in—

(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or

(B) Unacceptable delays in fulfilling the agency’s requirements.

Rationale or circumstances for limiting competition:

The Illumina NextSeq 500 platform was originally purchased by the Plant Germplasm Quarantine Program in 2017.  Illumina Inc is the only company that provides service for this  NextSeq platform.  The service covers remote technical support, next business day onsite response, on-site applications support, discounts on advanced training and remote monitoring. 

This Notice of Intent is not a request for competitive proposals.  No solicitation documents are available and telephone requests will not be honored.  However, if a vendor believes it can meet the requirements please contact  the Contracting Officer by  on  or  before the closing date of this notice.   Supporting evidence must be furnished in sufficient   detail to demonstrate the ability to comply with the above requirement.  The North American Industry Classification System (NAICS) code for this acquisition is 334516  Analytical Laboratory Instrument  Manufacturing , and the  Small business size standard is 1,000 Employees.
