This procurement is being conducted under 10 U.S.C.2304 (c) (1) FAR Subpart 13.106-1(b) (1). The FJEC has a requirement for TestMate TABE software. Data Recognition Corp/CTB is the only company that makes the TestMate TABE software products that are required for such testing and has proprietary rights to the requested products. FJEC have all the hardware that is compatible to this software to include computers and scanners. FJEC have the TABE paper and pencil score sheets as well and request the software to scan, score and report. It is more feasible to purchase the software than purchase a new system. It is more advantageous to the Government to award the contract services with Data Recognition Corporation ("DRC"), for a 30 (thirty) day delivery.

The anticipated award date is September 29, 2015. The North American Industry Classification System (NAICS) for this requirement is 334111 and the size standard is 1000 (one thousand) employees. A determination by the Government not to compete this requirement was based on responses to the previous sources sought notice. A solicitation will not be issued.
