SYNOPSIS
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) Subpart 5.2 - Synopses of Proposed Contract Actions.
The US Army Corps of Engineers, Portland District intends to award a sole source, firm-fixed price contract with TNT Software, Inc., 2001 Main Street, Vancouver, WA 98660-2673. The purpose of this acquisition is to renew the software licenses. TNT owns the proprietary rights to the software, therefore is the only authorized supplier of technical support services and version upgrades for the E75 ELM Enterprise Manager 7.5.
E75 ELM Enterprise Manager 7.5 items to be purchased are:
Quantity 31 – Item C1S, Class 1 System License
Quantity 1,418 – Item C2S, Class 2 System License
Quantity 256 – Item C1L, Class 1 Log License
Quantity 18 – Item C2L, Class 2 Log License
Quantity 97 – Item C2N, Class 2 Network License
Support and maintenance subscription renewal period of performance is 9/1/2020 - 8/31/2021
The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR Subpart 13.106-1(b) – Soliciting from a single source for purchases not exceeding the simplified acquisition threshold.
A SOLICITATION WILL NOT BE POSTED
The Government intends to proceed with this sole source action. The NAICS code used is 511210 - Software Publishers. The size standard as defined by the U.S. Small Business Administration is $41.5 million.
THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government by submitting a quote to the contracting officer before the notice end date. If no affirmative written responses are received by 12:00 PM Pacific Time on 18 August 2020 an award will be made without further notice. The US Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
