Opportunity Summary The purpose of this Invitation to Bid ("ITB") is to hire a Contractor to construct and install new kitchen cabinets with shelves and the installation of stone countertops for the benefit of the Oregon Department of Fish and Wildlife's Trask Hatchery located at, 15020 Chance Rd, Tillamook, OR 97141. The Work contemplated under this Contract includes all labor, materials, transportation, equipment, permits (not obtained by Owner), and services for, and incidental to, the completion of all Work in connection with the project described in the Contract Documents. The Work will take place in Clatsop County, Oregon. MANDATORY PRE-BID CONFERENCE: A mandatory pre-bid conference will be held on August 12, 2020 AT 10:00 AM (PT), located on site at the Trask Hatchery, 15020 Chance Rd, Tillamook, OR 97141. BIDDERS ARRIVING AFTER THE CONFERENCE HAS STARTED WILL NOT BE ADMITTED. Any statements made at this conference will not change the Plans, Specifications, or other Contract Documents unless an Addendum has been issued from ODFW and advertised on the ORPIN System. BIDDERS OR THEIR REPRESENTATIVE ARE REQUIRED TO ATTEND THE MANDATORY PRE-BID CONFERENCE. BIDS WILL ONLY BE EVALUATED FROM BIDDERS OR THEIR REPRESENTATIVE WHO REGISTERED AND ATTENDED THE ENTIRE MANDATORY PRE-BID CONFERENCE, AND ALL OTHER BIDS WILL BE CONSIDERED NON-RESPONSIVE. Due to COVID-19 concerns, practicing good hygiene and environmental cleaning must be followed. This will include maintaining physical distancing of six feet between Department staff and Contractor and their employees. Wearing face coverings is required. Due to the dynamic nature of the COVID situation, this contract may need to be modified if new CDC guidelines or state mandates prevent the operations listed. A MANDATORY Invitation to Bid (ITB) is attached. You must download the attachment and use the attached ITB to bid on the solicitation. MANUAL BIDS SUBMITTED ON THE ORPIN OPPORTUNITY WILL BE REJECTED AND CONSIDERED AS A "NO BID". YOU MUST USE THE ATTACHED MANDATORY FORM FOR ANY AND ALL MANUAL BIDS. ODFW reserves the right to cancel the solicitation, or reject in whole or in part, any or all quotes when the cancellation or rejection is in the best interest of the contracting Agency, in accordance with ORS 279B.100. The Agency may, in its sole discretion, terminate this Contract, immediately upon notice to Contractor, or at a later date as Agency may establish in its notice, upon the occurrence of any of the following events: 1. Agency fails to receive funding, appropriations, limitations, allotments or other expenditure authority at levels sufficient to allow Agency, in the exercise of its reasonable administrative discretion, to make payments under this Contract; 2. Federal or state laws, regulations, or guidelines are modified or interpreted in a way that either the purchase of Goods or Services, or both, by the Agency under this Contract is prohibited, or the Agency is prohibited from paying for Goods or Services, or both, from the planned funding source WARRANTIES: Unless otherwise stated, all goods shall be new and current model and shall carry full manufacturer warranties. Contractor warrants all goods delivered to be free from defects in labor, material and manufacture and to be in compliance with solicitation specifications. All implied and expressed warranty provisions of the Uniform Commercial Code (ORS chapter 72) are incorporated in this contract. All warranties shall run to the State. *Any reference to brand names is meant as descriptive not restrictive. Alternate bids will be considered on products, which meet or exceed products indicated on quote. Vendor is to mark clearly alternate proposals. "OR EQUAL": Any brand name listed in the specifications as "or equal" or "or equivalent" shall establish the minimum requirements for quality, utility, durability, function, purpose, etc. Other product brands may be offered that are equal to or better than the product brand name. Bidder may show cost differences, alternates and options in the space provided in the quote. This clause is not meant to be restrictive, but to set the minimum standard. AGENCY SHALL DETERMINE, IN ITS SOLE DISCRETION, WHETHER A PRODUCT OFFERED IS "EQUAL." When the designation is "or equal" or "equivalent" Agency shall make its decision after Bid Closing.
