The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b) (1), with
Omicron Nanotechnology USA, LLC of Eden Prairie, MN, for the acquisition of an Upgrade to an existing Low Temperature Surface Science System, needed by the Physical Measurement Laboratory (PML) at NIST, Gaithersburg, Maryland.

Sole Source determination is based on the need to upgrade an existing Low Temperature Surface Science System manufactured by Omicron Nanotechnology USA. The required upgrade will allow NIST to perform a reduction of noise present in small force measurements and ensure the accuracy of measurements from the instrument. Omicron Nanotechnology USA does not license other vendors to utilize their proprietary technology and they are the only known vendor capable of providing the required upgrade.

******A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.

*****No solicitation package will be issued. This notice of intent is not a request for quotations. However, responses received by August 21, 2012 will be considered by the Government.
