PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED. The Federal Bureau of Investigation (FBI) intends to negotiate a one-time, sole source, firm-fixed price purchase order with ViaSat, Inc for the purpose of procuring ViaSat TACLANES. The FBI requires (4) KOV-21: KOV-21 Card with 12 Month Warranty [2001], (4) KIK-30 / RASKL: 2 ft Flexible Common Fill Cable [1506], (4) KG-142 Ethernet Encryptor: KG-142 2x10G Ethernet Encryptor (EE) Long Reach (LR) [4006], and (1) KG-142 Ethernet Encryptor: KG-142 Fan Module [4506], (1) KG-142 Ethernet Encryptor: KG-142 Power Supply Module [4507], (4) KG-142 Ethernet Encryptor: QSFP+ 40GBASE-SR4, Fiber Optic Module Short Reach [4521], (4) KG-142 Ethernet Encryptor: Fiber Optic Breakout Cable [4523].

Based on market research conducted and contacts made with knowledgeable individuals within the Government and related industry, it has been determined that ViaSat, Inc is the sole developer/manufacturer of the FBI’s existing equipment and, due to their prominence in the Bureau, ViaSat is the only provider for products since they are the distributor and owner of this TACLANE products, software, and training. ViaSat does not have distributors or resell TACLANE products, software, or training, as they are National Security Agency (NSA) Certified Type 1 equipment and training. Since this is normally done through NSA as an Interagency Agreement, due to COVID-19 related restrictions, the FBI has been notified by NSA that they will not accept Interagency Agreements for the remainder of the fiscal year, and to purchase this controlled equipment via commercial contract from the only available source, ViaSat. All of the above reasons are what makes this contractor unique, in that they offer the Government equipment which no one else can provide.

This notice will be distributed solely through the General Services Administration’s beta.Sam.gov website (www.beta.Sam.gov). Interested parties are responsible for monitoring the beta.SAM.gov site to ensure they have the most-up-to-date information about this acquisition. The associated North American Classification System (NAICS) Code for the procurement is 334220 Radio and Television Broadcasting and Wireless Communications Equipment Manufacturing; the size standard is 1,250 employees.

The Government intends to negotiate with only one source under the authority of FAR 6.302-1. This notice of intent is not a request for competitive quotations; however, interested parties may identify their interests and capabilities to respond to the requirement by contacting Kayla Haley via email only at [email protected], no later than 10:00pm EST on Monday, September 28, 2020. Responses sent via other means (i.e. via telephone call, facsimile transmission, etc.) will not be considered. Information received will be used solely for the purpose of determining whether or not to conduct a competitive procurement. A determination by the Government not to compete this proposed contract based upon responses to this notice is at the discretion of the Government.

Vendors must be registered in SAM, effective July 29, 2012, to receive government contracts. The FBI utilizes a financial system that has a direct interface with the SAM. Please ensure that your company’s SAM information is updated and accurate. This includes: TIN, EFT, DUNs, addresses, and contact information. The EFT banking information on file in SAM will be what the FBI uses to process payment to your organization.
