This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopsis of Proposed Contract Actions."

US Army Corps of Engineers (USACE), Portland District intends to negotiate/award a sole-source contract with the Confederated Tribes and Bands of the Yakama Nation.

The U.S. Army Corps of Engineers, as a federal agency, must curate archaeological collections excavated from their property pursuant to the Antiquities Act (16 U.S.C. 431- 433), the Reservoir Salvage Act (16 U.S.C. 469-469c), section 110 of the National Historic Preservation Act (16 U.S.C. 470h-2), and the Archaeological Resources Protection Act (54 U.S.C. 300101). The Corps is in possession of numerous collections recovered from Corps lands.

The Portland District requires curatorial services to carry out this responsibility. The Confederated Tribes and Bands of the Yakama Nation currently provides professional care and management of the 45SA11 collection, and property of articles belonging to Native American tribes.

Yakama Museum is uniquely qualified to continue to curate the Portland District collections because of their knowledge of cultural requirements and their sensitivity to the needs of the tribes. The collection at the Yakama Museum is from an ancestral village in the ceded territory of the Yakama Nation. To use another facility would be a substantial duplication of cost to the Government that is not expected to be recovered through competition.

A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 712110 - Museums with a size standard of $15,000,000.00.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement to the contracting officer before the notice end date. If no affirmative written responses are received by 08:00 AM local time on 12 June 2018, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
