JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IAW FAR 6.303(a)(1-12): 1. Identification of the Agency and the Contracting Activity: Department of Veterans Affairs Aleda E. Lutz VA Medical Center VISN 11 Contracting Department 1500 Weiss Street Saginaw, MI 48602 2. Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of a construction contract to Repair Masonry Building 1 Aleda E. Lutz VA Medical Center, Saginaw, Michigan. 3. A description of supplies/services required: STATEMENT of WORK Contractor shall furnish all materials, labor, equipment, and supervision for preparation of masonry repair of Building 1, Aleda E. Lutz VA Medical Center, Saginaw, Michigan as required by drawings and specifications. Contractor shall completely prepare Building 1 and attached structures (excluding Building 22) for preservation, and perform repair of masonry. Contractor shall power wash exterior brick masonry, tuck point damaged mortar joints and previously tuck pointed areas, remove/replace bricks that are cracked/defective and cover existing coping with sheet metal coping. Work includes general construction and masonry repair. Contractor shall follow all applicable building codes. The contractor is responsible to perform a site survey and investigation to satisfy themselves as to the extent of the work. The period of performance for the work is 60 days. 4. Statutory authority permitting other than full and open competition: Public Law 109-461 and FAR 6.302-5, Authorized or Required by Statute. 5. Contractor's Unique Qualifications: Daniels Building Company has the current contract for Repair Masonry of Building 1. This project is an extension of the old project, to increase tuck pointing quantity, brick replacement quantity and sheet metal coping quantity. This shall be sole sourced since the contractor is on-site currently. 6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable: Not Applicable. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The anticipated award price of the contract between $100,000 and $250,000 will exceed the simplified acquisition threshold (as defined in section 4 of the Office of federal Procurement Policy Act (41 U.S.C. 403); and in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers the best value to the United States. 8. Market survey conducted: The concern Daniels Building Co. Inc. is a Service Disabled Veteran Owned Small Business registered in the Vendor Information Pages (VIP) database, available at www.VetBiz.gov. A review of Daniels Building Co. Inc; capability/profile information revealed that they have the experience, expertise and bonding level to perform the scope of work outlined in this project. Daniels Building Co. Inc. is determined to be a responsible source with respect to performance of such contract opportunity. Daniels Building Co. Inc. meets the requirements under Public Law 109-461, which gives the contracting officer authority to sole-source procurements to SDVOSB contractors. 9. Other facts: None 10.
