The Bureau of Reclamation, Snake River Area Office, Pacific Northwest Region, proposes to enter into a non-competitive contract with the Idaho Department of Fish and Game (IDFG) for the continued management of lands acquired and transferred to the State of Idaho on behalf of Reclamation for mitigation of the effects on fish and wildlife due to the construction of the Lower Teton Division Project. The Teton Mitigation Areas are located in Eastern Idaho. Reclamation's expired "contract" with IDFG to perform this work over the past 25 years was well documented. Examination of invoices and related charges provided us with a strong confidence level in both the accuracy of the charges, the appropriateness of their nature, and the correctness (fairness) of the dollar amounts requested as reimbursement. Reclamation's total estimated cost for this action is based upon recent incurred costs with an adjustment for inflation in out years. The authority for use of other than full and open competition is 41 U.S.C. 253(c)(1) as implemented by FAR 6.302-1, wherein the Government believes only one responsible source and no other will satisfy agency requirements. A Justification for Other than Full and Open Competition (JFOTFOC) has been prepared in support of this acquisition. The cited authority must be used because it is the only practicable method of acquisition due to the nature of the services to be acquired. IDFG is the state agency responsible for wildlife in Idaho. Additionally, The Teton Basin Project Act of September 7, 1964, Public Law 88-583, 78 Stat. 925, Sec. 1, states in part in the first sentence that: . . . in order to assist in the irrigation of arid and semiarid lands in the upper Snake River Valley, Idaho, to provide facilities for river power opportunities created thereby and, as incidents to the foregoing purposes, to enhance recreational opportunities and provide for the conservation and develpment of fish and wildlife, the Secretary of the Interior is authorized to construct, operate, and maintain the Lower Teton division of the Teton Basin Federal reclamation project. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses should include the firm's Dun and Bradstreet number (DUNS) and Tax Identification Number (TIN). Firms should identify themselves as either small business, or other than small business, in accordance with the size standard for North American Industry Classification System (NAICS) Code 924120, which is $7 million in gross annual receipts averaged over the previous three 1-year accounting periods.
