Notice of intent to award sole source procurement under the Simplified Acquisition Procedures (FAR 13) and Other Than Full and Open Competition (FAR 6.302-1). This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 811219 with a size standard of $19M average annual receipts. In accordance with FAR 6.302-1(a)(2)(ii)(A)  the Government intends to negotiate a sole source contract to authorize a one-time repair of a radiometer. The radiometer was fabricated by RPG Radiometer Physics, and no other company is capable of repairing it. The contractor has custom internally fabricated hardware, custom firmware within the radiometer, and custom software on an external controlling computer. Without access to the source code for the firmware and software, no other company can diagnose and repair it. The proper voltage ranges and levels for the subsystems within the radiometer, due to the custom design, are unknown to anyone other RPG Radiometer Physics. Other companies are unable to diagnose subsystem hardware problems. This is in contrast to RPG Radiometer Physics, which has established diagnostic procedures and spare components to perform the repairs on their own products. The Government is contracting for this service from which RPG Radiometer Physics GmbH is the only known source. A Sole Source Justification is attached to this notice. This notice of intent is not a request for competitive quotes; however, any firm that believes that it can provide the requirement above may give written notification to the Contracting Office. Responses to this notice must be submitted by the date/time listed on the notice. Interested sources may identify their interest and capability to respond to the requirement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 20 March 2014.
